Louisiana Indigent Defense Services Task Force
In 2003, the Louisiana Indigent Defense Services Task Force was created by House Resolution 151 (Sen. Lydia Jackson - Shreveport). It did not meet that year, but was continued by Senate Concurrent Resolution 136 (Sen. Lydia Jackson) in 2004. Senator Jackson served as the chair of the Task Force in 2004-2005.
Working over the course of a year, the Task Force voted by overwhelming consensus to make three legislative recommendations for the 2005 Legislative Session: SCR 23, SB 281 and SB 323. SCR 23 provides for and continues the Indigent Defense Services Task Force; SB 281 requires reporting of all major sources of income and expenditure for all agencies in the criminal justice system; SB 323 provides for uniform court fees, offers definitions of "case" and "indigency", grants the state indigent defense board increased authority to collect data and changes the board composition of the state indigent defense board.
While the session ended without substantive reforms to improve the delivery of indigent defense services, the new requirements lay a foundation for reform by collecting much-needed information that will help legislators create sound policies. It did not, however, address the "chronic underfunding" or the unreliable funding structure. Louisiana remains the only state in the nation to attempt to fund the majority of its Constitutional obligation to provide indigent defense services through court costs, primarily through fees collected from traffic tickets.
The Legislature passed Senate Concurrent Resolution 23 to continue the Louisiana Indigent Defense Services Task Force to assist policy makers in the 2006 Legislative Session. Sen. Lydia Jackson has stepped down as Chairperson and has been replaced by Rep. Daniel Martiny (R-Metairie).
The Task Force includes representatives from all three branches of government, public defenders, private attorneys, law enforcement, prosecutors, the faith community, client constituents, juvenile advocates, labor organizers, good government groups and minority organizations.
